Can i sue for a lasik wrong doing?

Corina
I had lasik this week and my doctor finisihed one eye and was in the middle of the second eye when he stopped. He could not proceed bc my flap did not fold over correctly. Now I have to wait for bad eye to hear and redo the procedure, take 4 days off, etc - I know I signed my life away, but is their still a chance to sue and what do I need to get to start?

Why would you want to sue a doctor who saved you from losing your vision? Would you rather he have continued the procedure even though the poor flap (these things do sometimes happen independent of your surgeons skills) could have resulted in a poor result? I never cease to be amazed how quickly someone who just minutes before had total and complete faith in their doctor can turn on them like a flash when something doesn't go right. It's people like you who have created a society in which we have to "sign my life away". Yes you can sue anybody for any reason, but I assure you on this one you will spend large amounts of money in the law suit and YOU WILL LOSE because yes you did sign your life away. What ever happened to patience and faith in your doctor that he really does want what is best for you and will do everything in his power to help you. You're pitiful.

I can't see you've any grounds, unless you did not have it explained to you that, even with good clinical procedures, this was one of the possible outcomes.Did you think everything *had* to go perfectly OK? Lasik is an elective surgical procedure with small but recognised risks. That's what the briefing and consent form are all about."Imperfect Flap Creation: A flap may be too thin, too thick, uneven, button-holed or even be too small. If the surgeon is not satisfied with the flap he may postpone the LASIK treatment. He would replace my flap and not treat with the laser. A decision would be made at a later time how to proceed. In most cases, vision remains unchanged from patient's current prescription. "From the sample consent form, below.

Get a second opinion. Most likely, a lawsuit under the circumstances you described would be a largely uphill battle. Most importantly you need to make sure you come out of this without any significant long-term complications.
